1. Introduction

Welcome to Byeloop ("the Application"). These Terms and Conditions ("Terms") govern your access to and use of the service provided by Arik Fallet, located at Via San Gottardo 51, 6500 Bellinzona, Switzerland ("we", "us", "the Owner"). By accessing, registering, or purchasing the service, you ("the user") agree to be bound by these Terms.

2. Service Description and Important Disclaimer

Byeloop is a 21-day digital guided course designed to support users in changing personal habits (self-help).

MEDICAL DISCLAIMER: The Application and its content are for educational and informational purposes only. Byeloop is not a medical device and does not provide psychological, psychiatric, or therapeutic advice. The use of the app does not replace the advice of a doctor or mental health professional. If you believe you are suffering from a psychological condition or disorder, please consult a specialist.

3. Account and Security

  • Personal Use: The purchase of the user license is strictly personal and non-transferable. Sharing your login credentials with third parties is prohibited.

  • Responsibility: You are responsible for maintaining the confidentiality of your password. You are fully responsible for all activities that occur under your account.

4. Payments and Refunds

Access to the course is granted via a one-time payment managed securely through Stripe.

Money-Back Guarantee (30 Days): We want Byeloop to be useful to you. If you are not satisfied with the service, you may request a full refund within 30 days of purchase.

  • Conditions: To obtain a refund, you must send an email to hello@byeloop.app explaining the reason for your dissatisfaction.

  • Abuse: We reserve the right to decline a refund request if we detect abuse of this policy (e.g., the user has completed the entire course and consumed all materials before asking for a refund without a valid, objective reason).

5. Intellectual Property

  • Byeloop Content: All text, videos, graphics, code, and the "Byeloop" brand are the exclusive property of Arik Fallet. Your purchase grants you a limited, non-exclusive, revocable license for personal use only. You may not copy, resell, or distribute the course content.

  • User Content: Any comments or notes posted by you within the app remain your property. However, you grant the Owner the right to host and display such content within the platform for the operation of the service.

6. Community Guidelines and Moderation

To ensure a safe and constructive environment, you agree to adhere to the following Community Rules:

  • Be Respectful: You agree to interact respectfully with other users.

  • Zero Tolerance Policy: Abuse, harassment, bullying, hate speech, sexually explicit content, or harmful messages are strictly prohibited and will not be tolerated. Violation of this rule will result in immediate account termination.

  • Reporting and Hiding: Each user has the ability to hide messages from other users and to report inappropriate content directly through the app interface.

  • Action on Reports (Within 12 hours): We take safety seriously. Every report is reviewed by our team, and we commit to taking appropriate actions (which may include content removal or a permanent user ban) within less than 12 hours of receiving the report.

Termination Rights: We reserve the right to suspend or terminate your account, without notice and without refund, if you violate these Terms or the Community Rules listed above.

7. Limitation of Liability

The service is provided on an "AS IS" basis. We do not guarantee specific results (e.g., the guaranteed breaking of a bad habit), as success depends on the user's personal commitment. To the fullest extent permitted by Swiss law, the Owner shall not be liable for direct or indirect damages arising from the use or inability to use the service.

8. Governing Law and Jurisdiction

These Terms are governed by Swiss Law. Any dispute shall be subject to the exclusive jurisdiction of the Courts of Bellinzona (Switzerland).
